Terms and Conditions

 
     
 

The terms of business below are are standard terms of business for course and boat hire through Recreational Diving Services Ltd or another approved facility.

  Course Terms and Conditions.

Reservations will only be confirmed upon receipt of a completed and signed Booking Form and payment of ­non-refundable deposit being 25% of the course fee
2 For Group Bookings the signatory or organizer accepts all conditions known to all participants.

Telephone bookings will be deemed provisional for 5 working days, and will be considered cancelled unless the booking form and deposit is received within 5 working days.

Where a deposit is made by credit card telephone method the booking is only confirmed when the fully completed booking forms is received.
5 The full course fees (less any deposit paid) must be paid 5 working days prior to the first day course.
6 All or any cancellations must be made in writing.

Cancellations received within in 48 hours of the commencement of the course will not be subject to refund. However at the discretion of the instructor, the student(s) may be able to transfer to another similar course commencing on a later date within six months. The only exception being that this does not apply to any bookings for boat fees and accommodation, which will be subject to terms & conditions of the relevant operator.

Check in times will be notified for each course. These check in times must be adhered to. Failure to do so may result in the student(s) not being able to complete the course.

The Medical Declaration must be completed by all student(s) and submitted with the booking form. The facility will not accept any booking, which is not accompanied by the Medical Declaration, and reserves the right to cancel any booking if the Medical Declaration reveals medical conditions that render the course unsuitable for the student concerned.

The facility will provide each student with a statement of Safety Policy before the course commences and it is a condition of the booking that students observe the provisions of such statement and any other directions given by the during the course.

Students shall be briefed of the safe practices involved in their chosen course. The facility shall not be held responsible for any student deviating from these instructions. And inflicting self-injury, Injury to others, damage to equipment. Or consequential loss however arising.

Where part of the content of a course is held outside and due to inclement weather that part of the course cannot be held, or is delayed,  cut short , or changed then The facility will not be responsible for any consequential loss or damage or expense incurred to the student, and any refund will be at the discretion of Andy Hetherton and subject to any reasonable expenses.

The facility  will not be responsible for any damage, loss, or injury to students whilst they are travelling to or from, or whilst on any dive site, boat, etc however arising.

In the event of staff sickness, equipment failure, or insufficient students, or other such similar circumstances, which make it necessary for the organisers to cancel a course, the maximum notice will be given and the full monies paid will be refunded.  The facility  will not be responsible for any consequential loss or expense incurred by the student.

Person’s using the equipment of the facility for any diving purpose will be responsible for the said equipment from the time of issue, and any loss or damage to the equipment arising from negligence of the student/hirer will be charged at replacement cost.

Whilst on a course, if any student is unsure of their obligations or objectives, or are not fully satisfied with the function of the equipment being used, they MUST immediately point this out to the instructor/ course leader. It is understood that unless this is carried out, the student is totally satisfied with all matters and the course will continue at the planned level.

All students are assumed to have made their own personal (or group) assessment of their physical ability and their level of health, related o the activity being carried out the facility will not be responsible for any incident, which relates to the poor health conditions or injury related to or from the activity concerned. The provision by the student of the Medical Declaration shall not in any way impose any responsibility on the facility in respect of any health conditions referred to in that declaration.
 
Conditions of Charter.

If for any reason a booking has to be cancelled by the Owner a full refund of any deposits paid will be made to the Charterer in full and final settlement of any claim the Charterer or member of his party may have against the Owner.

The payment for the charter of the vessel shall be the amount shown in the charter agreement paid in two instalments, the deposit to be sent with the completed and signed charter agreement and the balance to be paid not later than 30 days before the first day of the charter. In default of payment as provided in this clause the Owner shall be entitled to withdraw the vessel from service of the Charterer without prejudice to any other right or remedy he may have in respect of such non-payment.

Deposits accepted cannot be refunded, and the full charter price is payable unless a substitute Charterer for the same dates can be found. If successful any monies paid will be refunded less deductions for all expenses and allowances for any reduction in the rate or time of the charter.

Provisional bookings can be accepted by telephone and will normally be held for 5 working days (but less if made within two weeks of the commencement of the charter)

The Charterer shall provide sufficient instructors and/or other competent persons to supervise all diving activities and the use of diving equipment and shall be fully responsible therefor. The Owner /skipper and crew shall not be responsible for any accident or injury caused to any person or persons arising out of diving or the use of diving equipment.

Diving is normally restricted to a maximum depth of 40 metres. Charter groups wishing to dive to a greater depth than 40 metres must disclose this at the time of booking.

All day charters are based on the carriage of a maximum of 12 passengers and the carriage of not more than 24 diving air cylinders and associated sport diving equipment.

Where the Charterer or any of the party wish to use either Nitrox or Trimix diving gas and equipment the Owner must be notified at the time of booking in order that the weight and volume of the equipment can be assessed in order to prevent vessel overload.

The Owner/skipper reserves the right to insist on a reduced number of persons and/or equipment carried when he considers the weight and/or volume of equipment to be loaded aboard the vessel exceeds that normally carried for compressed air sport diving and/or constitutes a safety hazard.

A day diving trip will not normally be for more than 8 hours to begin at a time agreed between the Owner/skipper and the Charterer or his deputy.

Day diving is based on a maximum of two dives per day per diver

Day diving parties will not be permitted to use sleeping accommodation spaces reserved for liveaboard passengers.

No person shall bring hazardous or explosive substances aboard the vessel. Divers personal flares, recall devices and oxygen cylinders, etc., must be declared to the Owner/skipper on embarkation and stored strictly in accordance with his/her instructions. Under no circumstances may pure Oxygen be decanted or mixed aboard the vessel.

No person shall bring any illegal or banned substances aboard the vessel.

Neither party shall be liable if prevented from fulfilling any of its obligations by an accident of force majeure including an act of God, strike, lockout, act of Government or any other occurrence beyond his control.

Carriage thereunder is subject to the rules and limitations relating to liability established by the Athens Convention, as enacted in the Carriage of Passengers and their luggage, by sea, Domestic Carriage (Order 1987)

The Charterer shall not be entitled to assign the benefits of this agreement to any third party without the prior agreement of the Owner and shall remain liable notwithstanding any assignment made by him.

No action taken by the Owner, or failure to act, or time allowed to the Charterer or any failure by the Owner to insist upon and enforce its strict legal rights shall constitute a waiver of any of the provisions of the agreement which shall remain in full force and effect.

The Charterer undertakes to ensure that each member of the Charter Party is aquatinted with and agrees to the terms of this agreement and no claim of whatsoever nature be brought against the Owner skipper or Crew or any servant or agent of the Owner by the Charterer or any other member of  the Charter Party.

The best possible dives are chosen depending on the prevailing weather conditions and the experience of the divers. In due to adverse weather conditions the dive is cancelled by mutual consent then only the deposit will be non-refundable. If the decision to cancel is that of the Charterer no monies will be refunded.

In the event of cancellation where diving over 40 metres is planned (in accordance with condition 6 above) again no refund will be made except at the discretion of the Owner.
